Terms of Service

These terms are a general template written for an early-stage indie game and are provided for clarity, not as legal advice. Laws differ by jurisdiction. Please have a qualified lawyer review and adapt these terms to your business before relying on them.
1. Acceptance of these terms
Welcome to diceup, a free, browser-based, real-time multiplayer property board game available at diceup.io (the “Service”). These Terms of Service (“Terms”) form a binding agreement between you and diceup (“diceup”, “we”, “us”, or “our”).
By accessing or using the Service — whether as a guest or with an account — you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
2. Eligibility & age
You must be at least 13 years old (or the minimum age of digital consent in your country, such as 16 in parts of the EEA) to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian who agrees to these Terms on your behalf.
By using the Service you represent that you meet these requirements and that you are not barred from using the Service under any applicable law.
3. Accounts & guest play
You can play diceup as a guest using a locally stored nickname, with no account required. Creating an account is optional and lets you save a display name and cosmetics across sessions and devices.
If you create an account, you are responsible for keeping your credentials secure and for all activity that occurs under your account. Please notify us promptly of any unauthorized use. We may reclaim nicknames or display names that are impersonating, offensive, infringing, or misleading.
4. Acceptable use & prohibited conduct
diceup is meant to be fun and fair for everyone. When using the Service, you agree not to:
- cheat, exploit bugs, or use bots, scripts, or automation to gain an advantage;
- tamper with, reverse engineer, or disrupt the game client, servers, or network traffic;
- harass, threaten, bully, or discriminate against other players;
- post or transmit content that is illegal, hateful, sexually explicit, or abusive;
- impersonate other players, staff, or third parties;
- spam, advertise, or attempt to defraud or phish other users;
- collude to manipulate matches or the outcome of games; or
- attempt to gain unauthorized access to accounts, systems, or data.
We may remove content, end matches, and restrict or terminate access for conduct that violates these rules.
5. Virtual items & purchases
diceup offers optional cosmetic items such as coins, board designs, appearances, avatars, and visual upgrades. These items are purely decorative and are non-pay-to-win— they never affect gameplay, dice odds, or a player’s chance of winning.
- Virtual items are licensed to you for personal, non-commercial use within the game; you do not own them and they have no monetary or real-world value.
- Purchases are final and non-refundable except where required by applicable law.
- Virtual items cannot be exchanged for cash, transferred, or sold outside the Service, and the Service offers no real-money gambling of any kind.
- We may add, modify, or discontinue items, and we may adjust or remove items associated with an account that violates these Terms.
Payments are handled by a third-party payment processor subject to its own terms. You are responsible for any applicable taxes and for the accuracy of the billing details you provide.
6. Intellectual property
The Service, including its code, artwork, board designs, logos, sounds, and other content, is owned by diceup or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and play the game for your own entertainment.
diceup is an independent property-trading board game and is not affiliated with, endorsed by, or sponsored by any other game publisher or brand. You may not copy, distribute, modify, or create derivative works from the Service except as expressly permitted.
7. User content
You are responsible for the content you create through the Service, including nicknames, display names, and chat messages (“User Content”). You retain any rights you have in your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, display, and transmit it as needed to operate the Service — for example, showing your nickname and chat to other players in your room.
You must have the right to share any User Content you submit, and it must comply with Section 4. We may moderate, filter, or remove User Content at our discretion but are not obligated to monitor it.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that matches, progress, or virtual items will always be preserved. As a free, evolving game, features may change, break, or be discontinued at any time.
9. Limitation of liability
To the maximum extent permitted by law, diceup and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress, virtual items, or goodwill arising out of or related to your use of the Service.
To the extent liability cannot be excluded, our total liability to you for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or, where free to use, a nominal amount. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless diceup and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or of any law or the rights of a third party.
11. Termination & suspension
You may stop using the Service at any time, and if you have an account you may request its deletion. We may suspend or terminate your access — with or without notice — if you violate these Terms, if we suspect fraud or abuse, or if we need to protect the Service or other players.
Upon termination, your right to use the Service ends and associated virtual items and progress may be forfeited. Sections that by their nature should survive termination — such as intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.
12. Governing law & disputes
These Terms are governed by the laws of the jurisdiction in which diceup is established, without regard to conflict-of-law rules. You agree that any dispute will be resolved in the courts of that jurisdiction, unless applicable mandatory consumer-protection laws in your country of residence provide otherwise. Before pursuing a formal dispute, we encourage you to contact us so we can try to resolve the issue.
13. Changes to these terms
We may update these Terms as the game grows or as legal requirements change. When we make material changes, we will update the “Last updated” date at the top of this page and may provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.
